1.) Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under and also a valid contact telephone number and address. You agree to accept all of
the Terms and Conditions when signing up to NS-Hosting. If you are below the age 18, you agree that all Terms and Conditions will be viewed by the legal Parent/Guardian and will take all responsibility for any charges or damages that may be incurred from violating these Terms and Conditions.

2.) Content

All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene,
illegal pornography (dependent on state/country).

Examples of unacceptable material:

IRC War Bots
Ddos / Scanning Bots
Warez Sites
Pirated Software
Hate sites
Hack programs and archives
Copyright Material
Child Pornography
Phishing & scam sites

3.) Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice.

We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion.

We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion
of NS-Hosting. All rights reserved.

4.) Payment Information

You agree that until and unless you notify NS-Hosting of your desire to cancel any or all services received, those services will be billed on a recurring basis and should be paid within the 15 days of notification. If you wish to cancel please contact our billing department. sales@ns-hosting.net. Refunds will not be granted unless agreed by NS-Hosting.

All new signs up via PayPal give you the oppurtunity to create subscription payments with paypal, this authorises PayPal to send the signed up monthly fee once a month until termination of agreement. You agree that if PayPal subscriptions are cancelled, this will automatically notify NS-Hosting to terminate the services relating to this subscription unless otherwise agreed.

The Company may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not, in any way, relieve the Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and all collection fees, including legal expenses. Under no circumstances will payments be allowed to be claimed back through a 3rd party such as PayPal without contacting NS-Hosting first, this will count as a late payment and
interest will be applied as well as any legal and collection fees that NS-Hosting may incurr. A late fee of £3 will be applied to all accounts and will accrue daily.

We reserve the right to change the monthly payment amount and any other charges at anytime.
If payment is not paid on time we have the right to remove any of the contents on your account, and will not be liable for any loss of content or income.

5.) Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

6.) Cancellation and Refunds

*All payments to NS-Hosting are nonrefundable* and include any applicable setup fees and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the time that the dispute occurred. If you dispute a charge to your credit card issuer that, in NS-Hosting sole discretion, is a valid charge under the provisions of this Agreement and/or AUP, you agree to pay NS-Hosting an additional "Investigation Fee" of £80.

Any Cancellations must be reported to NS-Hosting 7 days before the next recurring charge is due, and 30 days for annual payments. Failure to do so does not entitle you to a refund for the next recurring charge taken.

7.) Resource Usage

Users may not initiate the following:

a) Use 10% or more of system resources for longer then 120 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP etc.

c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD, unless you have IRCD hosting package.

d) Run any software that interfaces with an IRC (Internet Relay Chat) network. (as above)

e) Attempt to modify any services that will provide increased capacity for the customer. This includes all types of media broadcasting, game servers, web hosting and any
other service that is supplied from NS-Hosting.

Any user found to be abusing the service may be terminated without prior notice.

8.) Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the
account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month. Additional bandwidth is charged at £1.00 per GB.

9.) Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or
any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from NS-Hosting's server.

10.) Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

12.) Changes to the TOS

We reserve the right to revise its policies and pricing at any time without notice.
